Whistleblowing or ‘Protected Disclosures’

Whistleblowing or to use their technical term “protected disclosures”, arise when an employee (or a member or partner in an LLP) reports to an employer certain types of wrongdoing by his or her employer or business. This will usually be in connection with something done at work. If the disclosure is in the public interest and is made in good faith then the whistleblower is protected by law and may not be treated unfairly, ie suffer a detriment, or be dismissed because he or she has made protected disclosures. Protection is afforded to disclosures in relation to criminal offences, health and safety, damage to

the environment, miscarriages of justice, unlawful conduct by their employer or that someone is covering up wrongdoing.

These are very difficult cases and claims for employers to face and they need to have the right policy in place to afford some protection and be able to deal with it as and when it arises.
