Redundancy and Restructuring

There are times when businesses need to either restructure or downsize, which can involve changes in the workforce. This may involve redundancy and restructuring, whether voluntary or compulsory.

In the case of either Blake-Turner advises employers on the process and steps to be taken in order to ensure that all legislation is complied with and that the employer is not left open to challenge. This will involve advising on when a redundancy situation arises and if it does, advising on selection pools, consultation periods, criteria, redundancy pay etc. A number of other issues such as pregnancy and maternity leave may have an impact on redundancy and these need to be looked at very carefully before undertaking restructuring.

When advising employees in a redundancy situation, Blake-Turner will examine whether it is a genuine redundancy situation or a “sham” process designed to terminate employment for other reasons.

Blake-Turner also regularly advises employees on settlement agreements as well as drafting settlement agreements for employees where employers and employees have agreed a severance package.
